Terms of Service

By downloading, installing, or using the Breath Noise mobile application ("App") or visiting our website at breathnoise.life ("Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App or Site.

These Terms apply to all users of the App, including visitors, free users, and premium subscribers. We may update these Terms at any time, and continued use of the App constitutes your acceptance of the revised Terms.

Breath Noise grants you a personal, non-exclusive, non-transferable, limited license to use the App for your personal, non-commercial purposes in accordance with these Terms.

You agree to use the App only for lawful purposes and in a manner consistent with all applicable local, national, and international laws and regulations.

You may use Breath Noise without creating an account. If you choose to sign in (via Google Sign-In), you are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Notifying us immediately of any unauthorized use of your account.

We reserve the right to terminate or suspend accounts that violate these Terms or engage in any prohibited conduct described in Section 6.

Breath Noise offers both a free tier and a paid Premium subscription. All premium purchases are processed through the Google Play Store and are subject to their payment terms and refund policies.

• Monthly Subscription: Billed monthly, auto-renews unless cancelled at least 24 hours before the renewal date.
• Lifetime License: A one-time purchase providing permanent access to all premium features available at the time of purchase and future updates.
• Free Trial: Where offered, a free trial will automatically convert to a paid subscription unless cancelled before the trial ends.

Refunds are handled in accordance with the Google Play Store refund policy. We are unable to process refunds directly — please contact Google Play support for refund requests.

All content within Breath Noise — including but not limited to the App design, audio recordings, visual scenes, brand name, logo, and source code — is the exclusive intellectual property of Gokul K S and is protected by copyright, trademark, and other applicable laws.

You may not:

• Copy, reproduce, or distribute any part of the App or its content without written permission.
• Attempt to reverse-engineer, decompile, or extract the source code of the App.
• Create derivative works based on the App or any of its content.
• Use the Breath Noise name, logo, or branding in any manner without prior written consent.

When using Breath Noise, you agree not to:

• Attempt to gain unauthorized access to any part of the App or its backend systems.
• Use the App in any way that could damage, disable, or impair the App or its servers.
• Use automated means (bots, scrapers) to access or interact with the App.
• Circumvent any digital rights management or subscription verification systems.
• Use the App for any commercial purpose without our express written consent.

Breath Noise is provided "as is" and "as available" without any warranty of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

We make no representations or warranties that the App will meet your specific requirements or that the results obtained from using the App will be accurate or reliable.

To the maximum extent permitted by applicable law, Gokul K S shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the App.

Our total liability for any claim arising from the use of the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. We may also add, change, or remove features as we continue to develop the product.

We may terminate or suspend your access to the App immediately if you violate these Terms. Upon termination, your right to use the App will immediately cease.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in India.
